The terms and conditions below govern the relationship between Outer Limits Promotions Pty Ltd t/a Buy Budgies (herein referred to as "The Company") and any user ("The User") of buybudgies.com website ("The Website"). By accessing and using any part of The Website, The User agrees to be bound and abide by the terms and conditions in this section. In the event that The User does not agree to all or part of the terms and conditions described below, he/she shall not access or use The Website in any way.

The User’s agreement to be bound by these terms is acknowledged by his/her use of The Website which includes, but is not limited to visiting The Website, using its internal and external links for search of information, ordering any of The Company services, contacting The Company representatives, Support Services and/or any software made available to The User by The Company.

The Company reserves the right to modify or revise the Terms of Use by updating this section. The User is solely responsible for staying up to date with these conditions by visiting the Terms of Use section of The Website regularly and checking for any updates.

PRODUCTS RETURN POLICY

Please check your order upon receipt. Damages, wrong or expired items and shortages must be reported to Buy Budgies immediately so that we can correct any problems. For damaged items, you must save all packing material and items for inspection. We will contact the delivering carrier immediately on your behalf.

Your business is appreciated. If you are not completely satisfied with an item, simply return it in its original, unused condition within 14 days of receipt along with the original invoice and it will be refunded, replaced, or exchanged for you. This does not include shipping and handling charges if applicable, however if it is oviously our fault, freight may reimbursed in certain cases ie: wrong or faulty product sent. The customer must either fax, e-mail or mail verification for these items to guarantee accuracy. Books, videos, CD's or DVD's are not returnable. Items that have been previously replaced because they were defective, damaged or incorrect are not returnable. Returned items showing signs of use are not subject to refund.

SELLING LIVE BIRDS POLICY

Using Free Breeders ads or the Buy Budgies store

The Seller warranties that Birds sold be in good health, be able to breed and do not have any known diseases, mite, or are carriers of diseases such as Polyoma Virus etc. .

The Seller warranties that the Birds have had preventative treatments fror Worms, Mite and Cocidiosis within the past 3 months if NOT this must be disclosed when listing the Bird for sale. The Seller also warranties that the Bird is not known to feather pluck, kill chicks or has consistantley produced infertile eggs after many rounds.

The Seller also warrenties that the Bird sold be the one advertised on Buy Budgies and that the photos have not been digitally maniplilated in any way. Buy budgies accepts no responsibility or liability for birds sold through Free Breeders Ads.

For Birds sold through Shopping cart (ie Buy budgies have an involvement)

PLEASE NOTE: when proceeding to checkout DO NOT choose Aust Post as a shipping option

Bird sales are handled 3 ways only

1. Pick up (you pay us then collect the birds from the breeder)

2. COD Brisbane only (we bring them to you $20)

3. Australian Air Express, (interstate Sales) you pay us then the breeder sends birds to your Airport to collect on same day. Cost is usually $65-$100 + transport cage ($20 1-3 birds) for most locations around Australia. Please note: Their is currently no insurance available for Air transporting Birds. You must choose this option at your own risk. All Birds must be paid for at time of shipment, the Seller is required to pay costs at airport or if buyer is at recieving Airport at same time he may pay costs. Buy Budgies will reimburse the seller for fright costs.

PLEASE ALSO NOTE:  When purchasing Birds through our shopping cart DO NOT add other products to your purchase, you must buy birds as a separate transaction because of different shipping and that the birds usually reside with the breeder not us etc. Please purchase other products as a new transaction or call us. (Unless you choose COD Brisbane only)

Live Birds, subject to the approval of the Seller, are returnable within 5 days from Shipment date (being at least 4 days after receiving stock) either for an exchange, refund or credit, This does not include shipping and handling charges if appliable. Buy Budgies does not accept any responsibility as to the well being or state of Live Birds. Professional veterinary advice should be sought in animal health matters.

In the Case of a new Bird being sent and /or and the return of the purchased bird, cost of Freight is by negotiation between the buyer and seller. Buy Budgies will act as a mediator to resolve any freight of refund issues.

When purchasing birds through our cart you deal with us not the breeder, however you may ask us or the breeder any questions through the enquiry form.

FREIGHT

If the buyer lives interatate they may nominate their preferred method of transport Buy Budgies uses Australian Air Express operated by Qantas airlines. Birds must be delivered to the Airport and picked up by the Buyer at the recieving airport. no insurance policies are offered by Australian Air Express

Indemnification

The Buyer and Seller agrees to indemnify and hold the Company harmless from and against any claims, losses, damages, liabilities, costs or expenses, attorneys’ and courts’ fees included, arising or related to the selling or purchase of Live Birds through this Website or by any other means.

Privacy Policy

The Company's Privacy Policy governs all collection, storage and usage of personal data. By accepting the terms and conditions in this section, the User expressly consents to the use and disclosure of his/her personally identifiable and other information. Any information given to Buy Budgies will not be passed onto any third parties with the exception of freight companies involved in delivering your order. Any online sales information sent is securely encrypted for processing and credit card details are not kept after the transaction has been completed and confirmed.

The Company Website Information Use

The User can use the information posted at The Company’s Website for informational purpose only. The information at The Website cannot be used in any other way without a prior written consent from The Company.

Third Parties Websites Use

The Company has no liability or responsibility for the accuracy or suitability of content on a third party website that can be reached by using The Company website. The User’s use of any content from a third party website, including but not limited to, information, downloadable files, etc. is at The User’s own risk.

Linked Websites

The User may find links to other websites on the Company’s Website. The published links are for informational purposes only. The Company does not control or endorse any information, products, or services offered at the linked websites. The User acknowledges that the access or use of any of the linked websites is at the User’s own risk and the Company shall not be liable for any loss or damage arising thereof.

Indemnification

Governing Law

The User agrees that this Agreement shall be governed in all respects by the laws and courts of Australia. The User agrees that any claim or dispute The User may have against Outer Limits Promotions Pty Ltd t/a Buy Budgies must be resolved by a court located in Australia without reference to any governing law rules that would result in the application of the substantive law of any other jurisdiction; The User hereby waives all rights to any kind of legal actions in any other court and/or under any other law except those of Australia; The User agrees to submit to the personal jurisdiction of the courts located within Australia for the purpose of litigating all such claims or disputes. In any legal action, the prevailing party will be entitled to recover all legal expenses incurred in connection with the action, including but not limited to its costs, both taxable and non-taxable, and reasonable attorney's fees. These Terms are effective unless and until terminated by the Company.
